Foreclosure Confusion – Help?
January 24th, 2012
I do not understand this note thing. My deed of trust states: borrower understands and agrees that MERS holds only legal title to the inerests granted by borroer in this security instrument, MERS has the right to foreclose. But Deutsche Bank is trying to foreclose on me. Is this accurate? I have been very lucky to this point as we have had 2 hearings scheduled and their attorney has continued them both due to lack of proper paperwork. I’m thinking I will not be so lucky next hearing date. Could you please let me know if Deutsche Bank can legally foreclose on my home or if it must be MERS. Thank you so much for any help.

Your lawyer would have already had the case dismissed if Deutsche did not have a legitimate lien on the property.
If you have their money and are refusing to part with it, yes, they will foreclose.
The Advertising Council, in partnership with NeighborWorks® America, launched a new set of national public service advertisements (PSA) designed to educate homeowners about where they can turn for help if they are at risk of foreclosure. The campaign encourages distressed homeowners to call the Homeowners HOPE Hotline, a free resource that helps homeowners facing foreclosure move closer to finding a resolution.
